Man Jailed For Stealing Mobile Phone

Magistrate Albert Moody yesterday sentenced Mohamed Mansaray to one (1) year imprisonment or pay a fine of one Million five hundred thousand Leones (Le1, 500.00) for conspiring with other unknown persons to steal mobile phone. The Principal Magistrate in delivering his judgement said that the accused was standing trial on two count charge of conspiracy to commit felony contrary to law and larceny contrary to section 2 of the larceny act 1916. He was found guilty on count one but was freed on count 2 on the grounds that the element was absent.
He further stated that for a person charged with larceny to be guilty of the offence, the element for which the person is accused of must be found on him or her during investigation, as earlier stated by the defence lawyer I.F. Sawaneh during his submission in court.
According to count 1, the particulars of offence state that the accused Mohamed Mansaray on Wednesday 19th October, 2016 at the intersection of Garrison Street and Abacha Street, Freetown conspired with other unknown persons to commit a felony to wit larceny by trick.
On count 2, the particulars of offence state that on Wednesday 19th October, 2016 at the same area as in count1, the accused Mohamed Mansaray did steal by trick one Samsung galaxy mobile phone valued at one million five hundred thousand Leones (Le1,500,000) from a car with Registration Number ALC 523 property of Amadu Kamara. The matter was prosecuted by Police Sgt. M. Sesay.
